Terms of Service

1. Acceptance of Terms

By creating an account, making a purchase, using the tools, listing content, participating as an affiliate, or otherwise using VocalPresets.com, you represent that you have read, understood, and agree to be bound by these Terms and by the following policies, which are incorporated by reference:

• •Our Privacy Policy, which describes how we collect and use information.
• •Our Refund Policy, which governs refunds for marketplace purchases, memberships, and credit packs.
• •The Seller Agreement, if you list or sell on the marketplace.
• •The Affiliate Terms, if you participate in the affiliate program.

If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

VocalPresets.com is a unified platform operated by Vocal Labs LLC. It includes a marketplace, first-party vocal tools, memberships billed in minutes (credits), and an affiliate program.

• •Marketplace. Sellers (producers, engineers, and other creators) list vocal presets and bundles. Artists browse, preview, and purchase those digital goods. Marketplace presets remain seller-created works. Vocal Labs is not the author of third-party preset files.
• •Tools. Vocal Labs provides first-party tools — AI Vocal Presets, Vocal Enhancer, and Vocal Recipe — that process vocal audio you upload. Tool use is billed in minutes (credits) as displayed in-product.
• •Memberships and credit packs. Plans currently include Starter (free), Artist, and Producer. Current list prices and allotments, as displayed at /plans, are: Starter at 5 minutes per cycle; Artist at $14.99 per month (or $11.99 per month equivalent when billed annually) with 100 minutes per cycle and a 10% marketplace discount; and Producer at $29.99 per month (or $23.99 per month equivalent when billed annually) with 300 minutes per cycle and a 15% marketplace discount. Credit packs currently include 50 minutes for $9.99 (90-day expiry) and 200 minutes for $29.99 (180-day expiry). We may change prices, allotments, and pack terms. The amount you pay is the amount displayed at checkout.
• •Affiliate program. Approved affiliates may earn commission by referring eligible purchases, subject to the Affiliate Terms.

Vocal Labs operates the Platform and provides the first-party tools and memberships described above. Vocal Labs does not create, publish, or license third-party marketplace preset files — those remain the works of the Sellers who list them.

3. Eligibility

To use the Platform, you must:

• •Be at least 13 years of age. If you are between 13 and 17, you must have the consent of a parent or legal guardian.
• •Have the legal capacity to enter into a binding contract in your jurisdiction.
• •Not be barred from using the Platform under applicable law.
• •Provide accurate and complete registration information.
• •Use any payment method only lawfully and only if you are authorized to use it, or if the person who is authorized has permitted the charge.

Sellers and affiliates must be at least 18 years of age. Sellers must also meet the eligibility requirements in the Seller Agreement. Affiliates must also meet the Affiliate Terms.

4. Accounts

You must register for an account to make purchases, download free presets, use the tools, list presets, or access most features of the Platform. Free preset downloads require an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at hello@vocalpresets.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or where we have reason to believe the account is being used fraudulently.

5. Marketplace Purchases

5.1 All Sales Final

All sales of marketplace digital goods on VocalPresets.com are final. Because presets and bundles are delivered as digital downloads, we cannot accept returns or issue refunds except in the limited circumstances described in our Refund Policy. Audio demos and compatibility information (including DAW and required plugins, where listed) are available on listing pages before checkout. By completing a purchase, you acknowledge that this information was available to review, that you agree the sale is final except as stated in the Refund Policy, and that you waive any right of withdrawal applicable to digital content that has been delivered and accessed.

5.2 License Grant

Upon completing a valid purchase, the Seller grants you a non-exclusive, non-transferable, worldwide license to use the purchased preset files for the following purposes:

• ✓Using the presets in your own music productions, recordings, and projects.
• ✓Releasing music commercially that was processed or created using the purchased presets.
• ✓Using the presets in client work, provided the underlying preset files are not delivered to the client.

This license does not permit you to:

• ✗Redistribute, resell, sublicense, or share the preset files themselves with any third party.
• ✗Upload the preset files to any other marketplace, platform, or file-sharing service.
• ✗Repackage or rebrand the presets and sell them as your own product.
• ✗Transfer your license or account to another person.

5.3 Re-downloads

You may re-download purchased presets from My Downloads. If a listing is removed under a DMCA notice, buyers who already purchased it retain download access during the review period. After a permanent legal removal or final takedown, we may not be able to keep hosting the files indefinitely and cannot guarantee continued access.

5.4 Reviews & Ratings

When you submit a product review on VocalPresets.com, your display name, star rating, and review text may be syndicated to third-party services such as Google Product Ratings to appear alongside product listings on Google Shopping and other discovery platforms. Reviews are shared using only your public display name — your email address, account details, and purchase information are never included. By submitting a review, you consent to this syndication.

6. Tools

The tools let you upload vocal audio so we can run the job you request. To process a job, we send that audio to subprocessors solely to run that job, including Kits.ai (AI Vocal Presets), the Vocal Enhancer worker, and the Vocal Recipe worker.

Input files are deleted after approximately 24 hours. Temporary Vocal Recipe uploads are deleted after approximately 1 hour. Tool outputs remain available for approximately 7 days, after which they may expire and become unavailable for download.

Starter and other free-tier tool output may be watermarked. Paid memberships include commercial use of your music after it is processed through the tools. You still own your recording. The tools do not grant you any rights in someone else's voice, voice model, or other third-party intellectual property.

You may upload only audio you have the rights to use. You may not upload content that is illegal or that infringes another person's rights.

Minutes and credits are consumed as displayed in-product at the time you run a job. Subscription minutes reset each billing cycle and do not roll over. Credit packs expire as stated at purchase.

7. Memberships, Credits & Billing

Paid memberships and credit packs are billed through Stripe. You may cancel a membership at any time from your account billing portal. There is no cancellation fee. After you cancel, you keep access through the end of the paid period unless applicable law requires otherwise.

Marketplace member discounts (currently 10% on Artist and 15% on Producer) are funded by the Platform. They are not deducted from the Seller's share of a sale.

Refunds for memberships and credit packs are governed by the Refund Policy. These Terms do not promise a pro-rata refund if you cancel mid-cycle.

Prices are stated in United States dollars. We do not currently collect VAT or GST. Tax treatment may change, and any tax shown at checkout will be part of the amount due.

8. Affiliates

If you participate in the affiliate program, you agree to the Affiliate Terms. Affiliate commission is taken from the Platform's share of a sale, not from the Seller's earnings. Self-referral is prohibited.

9. Seller Terms

Sellers are subject to the full Seller Agreement, which governs eligibility, revenue share, payout schedule, content standards, and account policies. A summary of key terms:

• •You must own or hold all necessary rights to any content you upload for sale, including the presets, cover art, and audio demos. You may not sell stolen or infringing content.
• •The standard platform fee is 30% of each sale (seller keeps 70%). Individual rates may vary.
• •Sellers on Stripe Connect Express receive weekly payouts with a $25 minimum threshold. Sellers on platform payout mode do not receive automatic Connect transfers; those earnings are retained on the platform Stripe account until paid under that mode.
• •All presets are reviewed by our team before going live. Review takes 2–3 business days.

10. Prohibited Content

The following content is strictly prohibited on VocalPresets.com:

• ✗Stolen presets — presets ripped from another creator's commercial product, unlicensed copies, or content you do not own.
• ✗Misleading listings — preset descriptions that materially misrepresent the preset contents, preset count, DAW compatibility, or required plugins.
• ✗Malware — ZIP files or any files that contain malicious code, scripts, executables, or software of any kind.
• ✗Adult or obscene content — sexually explicit cover art, audio, or any content inappropriate for a general audience.
• ✗Content that violates any applicable law, including content that infringes third-party intellectual property rights.
• ✗Spam or coordinated inauthentic behavior — fake reviews, purchased ratings, or manipulation of any platform ranking system.

Violations may result in immediate preset removal, account suspension, and forfeiture of any pending payouts. We reserve the right to report violations to applicable authorities.

11. DMCA / Intellectual Property Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and its international equivalents. If you believe that content on our Platform infringes your copyright, please send a written DMCA notice to:

Upon receiving a valid DMCA notice, we will act promptly to remove or disable public access to the allegedly infringing content. Sellers may file a counter-notice within 10 business days. Buyers who already purchased the content retain download access during the review period.

Repeat Infringer Policy: We will terminate accounts determined to be repeat infringers. A second upheld DMCA notice against a seller will result in permanent account termination.

12. Payment Processing

All payments on VocalPresets.com are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. Sellers who receive payouts through Stripe Connect Express must agree to the Stripe Connected Account Agreement during onboarding.

The default marketplace path is a Stripe Connect destination charge. Stripe collects the payment and splits it at the time of sale: the Seller's stated share is transferred to that seller's Connect account, and Stripe processing fees are taken from the Platform's share. On that path, Sellers receive their stated percentage of the gross sale price.

Some Sellers are on platform payout mode. In that mode, funds are collected on Vocal Labs' Stripe account and are not automatically transferred through Connect. Those seller earnings stay on the platform Stripe account until paid under that mode.

Vocal Labs LLC is not a bank, money services business, or payment processor. Connect Sellers receive transfers through Stripe. Platform-mode seller earnings are retained on the platform Stripe account until paid as described above. We never store full card numbers or bank account details.

In the event of a payment dispute or chargeback, we will cooperate with Stripe's dispute resolution process and may provide transaction evidence to Stripe.

13. Disclaimers & Limitation of Liability

The tools are likewise provided “AS IS”. Results vary by vocal, microphone, room, and source recording. We do not guarantee a particular sound or commercial outcome.

We do not endorse, guarantee, or take responsibility for any content, product, or representation made by Sellers on the marketplace. Marketplace presets are independent creator works — Vocal Labs LLC is not the author or licensor of third-party preset files. Vocal Labs does provide the first-party tools and memberships described in these Terms.

Limitation of Liability. To the maximum extent permitted by applicable law, Vocal Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total cumulative liability to you for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of (a) the total amount you paid to VocalPresets.com in the twelve (12) months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

14. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware. Before filing any formal legal proceeding, you agree to contact us at hello@vocalpresets.com to attempt an informal resolution.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or platform features. The current version will show the “Last updated” date at the top of this page. When we make material changes, we will notify you by email or in-app notification.

Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and may close your account.
