1. Acceptance of Terms

By creating an account, making a purchase, or listing content on VocalPresets.com, you represent that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

VocalPresets.com is a two-sided digital marketplace that connects independent creators (“Sellers”) who produce vocal presets with music producers and artists (“Buyers”) who purchase them. Vocal Labs LLC is not a creator, publisher, or licensor of the presets listed on the Platform — we provide the infrastructure for transactions to take place between Sellers and Buyers.

All digital products sold on the Platform are vocal presets — collections of settings, chains, and configurations for digital audio workstations (DAWs) and plugins designed to process vocal recordings.

3. Eligibility

To use the Platform, you must:

• •Be at least 13 years of age. If you are between 13 and 18, you must have the consent of a parent or legal guardian.
• •Have the legal capacity to enter into a binding contract in your jurisdiction.
• •Not be barred from using the Platform under applicable law.
• •Provide accurate and complete registration information, including a valid payment method where required.

Sellers must be at least 18 years of age and must have a valid Stripe account capable of receiving payouts. See the Seller Agreement for full seller eligibility requirements.

4. User Accounts

You must register for an account to make purchases, list presets, or access most features of the Platform. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at support@vocalpresets.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or where we have reason to believe the account is being used fraudulently.

5. Buyer Terms

5.1 All Sales Final

All sales of digital goods on VocalPresets.com are final. Because presets are delivered as digital downloads, we cannot accept returns or issue refunds except in the limited circumstances described in our Refund Policy. By completing a purchase, you acknowledge this policy and waive any right of withdrawal applicable to digital content that has been delivered and accessed.

5.2 License Grant

Upon completing a valid purchase, the Seller grants you a non-exclusive, non-transferable, worldwide license to use the purchased preset files for the following purposes:

• ✓Using the presets in your own music productions, recordings, and projects.
• ✓Releasing music commercially that was processed or created using the purchased presets.
• ✓Using the presets in client work, provided the underlying preset files are not delivered to the client.

This license does not permit you to:

• ✗Redistribute, resell, sublicense, or share the preset files themselves with any third party.
• ✗Upload the preset files to any other marketplace, platform, or file-sharing service.
• ✗Repackage or rebrand the presets and sell them as your own product.
• ✗Transfer your license or account to another person.

5.3 Re-downloads

You may re-download purchased presets at any time from your account at My Downloads. We make reasonable efforts to keep purchased presets available for re-download; however, in the event a preset is removed from the Platform for legal reasons, we cannot guarantee continued access.

6. Seller Terms

Sellers are subject to the full Seller Agreement, which governs eligibility, revenue share, payout schedule, content standards, and account policies. A summary of key terms:

• •You must own or hold all necessary rights to any content you upload for sale, including the presets, cover art, and audio demos. You may not sell stolen or infringing content.
• •The platform fee is 30% of each sale for Standard sellers (seller keeps 70%) and 20% for Founding Sellers — the first 10 approved sellers — who permanently retain 80%.
• •Payouts are processed weekly via Stripe Connect Express with a $25 minimum threshold.
• •All presets are reviewed by our team before going live. Review takes 2–3 business days.

7. Prohibited Content

The following content is strictly prohibited on VocalPresets.com:

• ✗Stolen presets — presets ripped from another creator's commercial product, unlicensed copies, or content you do not own.
• ✗Misleading listings — preset descriptions that materially misrepresent the preset contents, preset count, DAW compatibility, or required plugins.
• ✗Malware — ZIP files or any files that contain malicious code, scripts, executables, or software of any kind.
• ✗Adult or obscene content — sexually explicit cover art, audio, or any content inappropriate for a general audience.
• ✗Content that violates any applicable law, including content that infringes third-party intellectual property rights.
• ✗Spam or coordinated inauthentic behavior — fake reviews, purchased ratings, or manipulation of any platform ranking system.

Violations may result in immediate preset removal, account suspension, and forfeiture of any pending payouts. We reserve the right to report violations to applicable authorities.

8. DMCA / Intellectual Property Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and its international equivalents. If you believe that content on our Platform infringes your copyright, please send a written DMCA notice to:

Upon receiving a valid DMCA notice, we will act promptly to remove or disable access to the allegedly infringing content. Sellers may file a counter-notice within 10 business days.

Repeat Infringer Policy: We will terminate the accounts of users who are determined to be repeat infringers. A second upheld DMCA notice against a seller will result in permanent account termination.

9. Payment Processing

All payments on VocalPresets.com are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. Sellers who receive payouts through the Platform do so via Stripe Connect Express and must agree to the Stripe Connected Account Agreement during onboarding.

When a Buyer completes a purchase, the payment is collected by Stripe on behalf of the Platform. Stripe automatically splits the payment: the platform fee is retained by Vocal Labs LLC and the Seller's share is transferred to their Stripe Connect Express account. Stripe's processing fees are deducted from the platform's share — Sellers receive their full stated percentage of the gross sale price.

Vocal Labs LLC is not a bank, money services business, or payment processor. We do not hold funds in escrow or act as a custodian of any funds. Payment processing, fraud detection, and fund transfers are handled entirely by Stripe. We never store full card numbers or bank account details.

In the event of a payment dispute or chargeback, we will cooperate with Stripe's dispute resolution process and may provide transaction evidence to Stripe on behalf of the relevant Seller.

10. Disclaimers & Limitation of Liability

We do not endorse, guarantee, or take responsibility for any content, product, or representation made by Sellers on the Platform. Presets are independent creator works — Vocal Labs LLC is not the author or licensor of any preset.

Limitation of Liability. To the maximum extent permitted by applicable law, Vocal Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total cumulative liability to you for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of (a) the total amount you paid to VocalPresets.com in the twelve (12) months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

11. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware for any claims not subject to arbitration. Before filing any formal legal proceeding, you agree to contact us at support@vocalpresets.com to attempt an informal resolution.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or platform features. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify users by email or in-app notification.

Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and may close your account.
